The City of Albemarle nuisance ordinances ensure properties are maintained in a clean, safe and sanitary condition. Code Enforcement addresses complaints regarding properties that are not in compliance with these regulations. Nuisance complaints concern violations in open areas (porches are considered open areas).

What defines nuisance violations?

The City of Albemarle requires residential and commercial properties to be maintained in a way that ensures harmony and conformity with maintenance standards throughout the city. Some examples of things that can have a negative impact on our quality of life include, but are not limited to:

  • Overgrown weeds.
  • High grass.
  • Offensive animal matter.
  • Offensive vegetable matter.
  • Rubbish.
  • Junk.
  • Garbage.
  • Litter.
  • Trash.
  • Accumulation of unused building/construction material.
  • Dilapidated furniture.
  • Scrap materials.
  • Dilapidated fences.
  • Junk, abandoned, derelict vehicles.
  • Illegal signs.

What happens next?

Code Enforcement will conduct an inspection, in a timely manner, of the property to determine if any violations exist on the property. If there appears to be an ordinance violation, the officer will determine the action necessary to comply with the ordinance, which may include the following:

  • A “Notice of Violation” will be sent to the property owner. This notice will describe the violation, and give a corrective action the property owner can take to bring the property into compliance with our code. The notice will also contain a date that the property must adhere to the corrective action by.
  • If this time elapses without compliance, a Civil Citation will be issued. A hearing may be scheduled as well.
  • Penalties will continue to accumulate until the property has been brought into complete compliance with the code of ordinances.
  • If the property owner still does not comply with the order, the City of Albemarle will abate the issue(s) and place a lien on the property for the cost to the city, and/or send the cost of abatement to a collection agency.
